Supreme Court’s clean chit to Narendra Modi in Gujarat riots case

The apex court had directed the SIT to probe all the allegations in the 2011 Gujarat riots. In February 2012, the SIT filed a closure report on the complaint. Clean chit to 64 in SIT’s closure report

A bench of the apex court comprising Justice AM Khanwilkar, Justice Dinesh Maheshwari and CT Ravi Kumar reserved its order on December 9, 2021. Petitioner Zakia Jaffrey had challenged the closure report filed by the SIT investigating the riot cases. The closure report gave a clean chit to 64 people. One of the innocent survivors was Prime Minister Narendra Modi. He was the then Chief Minister of Gujarat at the time of the riots. Jaffrey’s husband was killed in a riot at Gulbarga Society. He claimed that there was a big conspiracy behind the riots and lodged a complaint in 2006.

The apex court had directed the SIT to probe all the allegations in the 2011 Gujarat riots. In February 2012, the SIT filed a closure report on the complaint. Petitioner Zakia Jaffrey then filed an application in the lower court challenging the closure report. However, his appeal was rejected. Then in 2018, Zakia Jaffrey knocked on the door of the Supreme Court. Earlier, an appeal was also filed before the Gujarat High Court against the closure report. However, the High Court had also rejected the appeal on October 5, 2017. The petitioners then moved the Supreme Court in 2018. During the hearing of the case, senior counsel Kapil Sibal appeared for the petitioners, while Solicitor General Tushar Mehta appeared for the state government. Senior Advocate Mukul Rohatgi also appeared for SIT.

More than 1000 people were killed in the riots!

The riots erupted on the second day after 59 people returning from Ayodhya were killed in the Godhra train fire. More than 1,000 people were killed in the riots. Ehsan Jaffrey was one of the 69 people killed in Ahmedabad’s Gulbarga Society after a train fire on February 28, 2002. His wife continued the legal battle.
